At the heart of European justice: Hugh Mercer KC joins Strasbourg court

Hugh Mercer KC (1981) has been appointed as the UK’s Judge on the European Court of Human Rights. Based in Strasbourg, the court is responsible for upholding human rights and the rule of law across 46 member states. 

“Hugh Mercer’s appointment is a source of great pride for the College. It reflects both his distinguished career and the strength of Downing’s legal tradition. We are delighted to see one of our alumni contributing at the highest level to the protection of human rights and the rule of law,” said Professor Graham Virgo KC (Hon), Master.

In this short interview, Hugh reflects on the significance of his appointment, his ambitions for the role, and the influence of his time at Downing.

What does this appointment mean to you?

It is an honour and a privilege to be elected to the bench of an international tribunal in respect of the United Kingdom. More broadly, at a time when the world feels increasingly unstable, the Council of Europe continues to play a vital role in maintaining stability and upholding shared values across Europe. To contribute, even in a small way, to that work is a responsibility I take very seriously.

What do you hope to achieve during your term, and what are you most looking forward to?

I hope to ensure that the voice of the United Kingdom and the common law is a strong one at the Court. UK case law is already frequently drawn upon in judicial discussions, and I expect that influence to continue. I also hope to play a significant role in developing and consolidating the caselaw of the Court, whilst remaining faithful to the text of the Convention. 

"I am particularly looking forward to engaging with the wide range of cases that come before the Court, following the exhaustion of domestic remedies, and to the important role that comparative law plays in its work. Above all, I look forward to sitting regularly in the Grand Chamber, where proceedings most closely resemble UK court practice, with oral hearings followed by detailed rounds of discussion and deliberation leading to judgment.

What role did Downing play in your journey?

Downing provided an excellent foundation. It was a place where I was taught to think like a lawyer, not least through the rigour of the supervision system in which silence was not an option. Above all, the fact that Downing lawyers have permeated most corners of the UK legal system gives almost a sense that one is a member of a wider team and perhaps suggests that no part of the legal system is off-limits.
